I Felty Fenner of the County of Highland and State of Ohio being weak in body and considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my last will and Testament in manner and form following that is to say First I give and devise and bequeath unto my beloved wife Nancy Fenner during her lifetime all my Estate both real and personal of every Kind and description whatsoever including all my money and notes and accounts due or owing to me by any person or persons Except such bequeaths as is herein after mentioned - My said beloved wife Nancy Fenner shall be allowed the privilege of buying the privilege of buying the land whereon she now lives with any money or property she holds in her hands and to hold possession of said land if purchased during her lifetime and after that time is to be equally divided among all my children as my other lands and property as is herein after mentioned - I also give and bequeath to my eldest son John Fenner one cow so soon as his mother can spare one -- I also give and bequeath unto my youngest daughter Elenor Fenner one young sorrell mare one cow and new saddle and when she marries she is to have as much household and Kitchen Furniture as either of her sisters have received I also give and bequeath unto my son Allen Fenner one young gray mare one cow and when he invoices as much other property that shall amount in value to what either of his other Brothers have received - provided the said Allen does stay with and help take care of his mother during her lifetime -
Highland County, Ohio Probate Court Book 1-3, Pages 262I also give and bequeath unto my younger son William Fenner one young gray mare one cow and when he marries as much other property that shall amount in value to what either of his other brothers have received provided that he stay with and help to take care of his mother during her lifetime - I have also given my sons Stephen Fenner Isaac Fenner Dorsey Fenner Joseph Fenner and my daughter Katharine Graham late Katharine Fenner Phebe Sevarts late Phebe Fenner Elizabeth Manker late Elizabeth Fenner their respective shares of my Estate during the lifetime of their mother. after the death of my said beloved wife Nancy Fenner I do hereby devise and bequeath unto my said sons John Fenner Stephen Fenner Isaac Fenner Dorsey Fenner Joseph Fenner and to my daughters Katharine Graham late Katharine Fenner Phebe Sevarts late Phebe Fenner Elizabeth Manker late Elizabeth Fenner and Eleanor Fenner and my younger sons Allen Fenner and Wilson Fenner all the ballance of my Estate both real and personal all money and property of every kind and description whatsoever after all funeral expenses and other debts are discharged is to be equally divided among the above mentioned heirs all of the above mentioned property if not agreed upon and divided among the said heirs themselves to be sold by my executors and divided equally as above mentioned so soon as my Executors can cause said property to be sold and the money collected not to exceed two years from the death of my Executrix - I do hereby appoint my wife Nancy Fenner my Executrix of this my last will and Testament and after her death my eldest son John Fenner shall be my Execution of this my last will and Testament hereby revoking all former wills by me made. in Testimony whereof I have hereunto set my hand and seal this eleventh day of June in the year of our Lord one thousand eight hundred & thirty four.
