James Fenner's Will

I, James Fenner of the County of Highland in the State of Ohio
being weak in body but of sound mind and memory, do publish
this my last will and testament in manner and form following
that is to say --

     1st It is my will that my funeral expenses and just
debts be fully paid.

     2nd It is my will that my daughter Rosannah Robin-
son, late Rosannah Fenner have two hundred dollars to be paid
to her by my executor in her own hand, or in case of her death,
to her heirs.

     3rd It is my will that my estate both real and personal
be sold by my executor and the proceeds of said sale:  after paying
my debts and the above two hundred dollars be equally divided
amon the balance of my children, namely John Fenner, Eliza-
beth E. Kidd, late Elizabeth Fenner, Lucinda Fenner, Eliza Fenner,
Delilah Fenner, James R. Fenner, share and share alike except
the two youngest, namely Delilah Fenner and James R. Fenner
is to have one hundred dollars each more than the rest.

     4th It is my will that the money belonging to my miner heirs
be loaned to some responsible person or persons until they become
of age.

     5th I do hereby nominate and appoint my friend Jeremiah Manker
Executor of this my last will and testament revoking all former
wills by me made and confirming this and no other.  Given under
my hand this 6th day of September A.D. 1854.

     The State of Ohio  }
                        } ss.
     Highland County    }

                         This day the last will and testament of James
Fenner, deceased, late of Highland County, Ohio was produced in open Court
whereupon came personally Dorsey Fenner and Abraham Lowman subscribing witnesses
thereto who being duly sworn according to law upon the oaths say that said James Fenner
at the time of making said last will and testament hereunto annexed was over the age of twenty-
one years of sound mind and memory and not under any restraint that he voluntarily subscribed
said last will and testament and in their presence and hearing published and declared the same to be his
last will and testament and that they in his presense and in the presence of each other and at
his request signed the same as subscribing witnesses thereto.

Sworn to and subscribed in open Court this 11th day of September A.D. 185.
