Compliance Monitoring

We continue to fund Compliance Monitoring and tracking in Municipal court. This service is critical to assuring compliance with sentencing. Studies have shown that those offenders placed on probation for misdemeanor crimes commit fewer felonies in the future. Our DWI Substance Abuse Task Force recognizes this component as one of the most important and viable requests for funding and in reducing DWI offenses. We have increased our reporting to the ADE over 50% since the funding of this component in Municipal court and the provision of office space to the Magistrate Court compliance.

             The Compliance Monitor will; Follow AOC guidelines for Misdemeanor compliance,

Meet with and enroll the defendant immediately following a sentence hearing.

Go over the entire Judgment and Sentence with the defendant ensuring that he/she fully understands everything ordered by the Judge and the time frame that is allowed to comply and complete the orders. (Most, 90 days).

The defendant will sign an agreement to appear in person (minimum of once a month) as scheduled by the Contractor, to contact the Contractor by telephone once a week minimum. The Contractor shall meet with the defendant (a minimum of once a month) to ensure that the Contractor and the court have the following information: 

(a)         The defendant’s most current address;

(b)         Telephone number;

(c)         Place of employment;

(d)         The fines and costs imposed are paid;

(e)         The screening is completed and paid;

(f)          DWI School is completed;

(g)         That treatment (when ordered) is arranged with the assistance of the contractor, and attendance is monitored until completed; and

(h) That the defendant is in compliance with all orders and conditions of probation

(i)          That the defendant has information on ignition interlock and if ordered does comply .

The desired outcome is that through probation services provided we will increase the rate of compliance as well as the timeliness of compliance from court ordered community service, alcohol screening, DWI school, ignition interlock and all other conditions stipulated by the courts.
