ORDINANCE 2008-____ AN ORDINANCE THAT WILL REVISE STREETS, SIDEWALKS, AND PUBLIC WAYS FOR THE VILLAGE OF CAPITAN

WHEREAS, The Village of Capitan is a New Mexico municipality; and

WHEREAS, The Governing Body of the Village of Capitan is charged with making laws to insure the efficient operation of the Village; and

WHEREAS, The Governing Body of the Village of Capitan acted in regular session on June 10, 2008 to approve the replacement of Title 7 – Public Ways and Property, Chapter 1 – Streets, Sidewalks and Public Ways, Section 7-1-1 with the following:

Section 7-1-1:  Street Culverts and Drains:

A.     Owner Responsibility:  Each owner of real property within in the Village limits and whose property abuts upon a Village Street may contact the Village of Capitan to install culverts in each access driveway that intersects with a village roadway or right-of-way, unless expressly exempted by the Village Street Department.  The owner may opt to install the culvert himself or hire a contractor to do the installation.

B.    Culverts shall be constructed of galvanized corrugated steel pipe and shall be of adequate design and capacity to handle the flow of water during times of high water.  Prior to the installation of the culvert by the property owner or contractor, the property owner shall contact the Village Street Department for approval of the design and capacity specifications of the proposed culvert.

C.    If the property owner wants the Village Street Department to install a culvert, he/she will need to contact the Village.  The Street Department will fill out an estimate and present it to the property owner.  The estimate will include the size and length of the culvert needed, base course, delineator posts and buttons, and hourly fee to install the culvert.  The cost will cover the price of the needed materials and the labor to install the culvert.  If the estimate is accepted, the fees will be paid in full and a work order will be issued to the Street Department to install the culvert.

NOW THEREFORE, be it ordained by the Governing Body of the Village of Capitan to replace the existing Title 7 – Public Ways and Property, Chapter 1 Section 7-1-1 of the Municipal Code with the above Street Culverts and Drains.
