REVISING PERSONNEL POLICIES AND PROCEDURES REGARDING VACATION AND SICK LEAVE


WHEREAS, The Village of Capitan is a New Mexico municipality; and

WHEREAS, The Governing Body of the Village of Capitan is charged with making laws to insure the efficient operation of the Village; and

WHEREAS, the Governing Body of the Village of Capitan acted in regular session on Tuesday, September 12, 2006 to approve the changes to the Personnel Policies and Procedures that will repeal Title 1, Chapter 7, Sections 9.5, 9.6, and 9.11 of the Employee Benefits of the Village of Capitan Municipal Code regarding the employee’s vacation and sick leave

NOW THERFORE, be it ordained by the Governing Body of the Village of Capitan that the following sections be adopted:

9.5: VACATION:  Vacation leave is intended primarily to provide each permanent employee with a paid vacation each year; although it may be used for other employee needs requiring absence during working hours.  Each employee will receive their vacation hours on their anniversary date of employment.  The employee is expected to use their vacation leave each year and a maximum of 80 hours may be carried over on their anniversary date.  Any amount of vacation leave that exceeds the maximum will be written off and forfeited by the employee.  Leave should be planned and requested as far in advance as practicable, in order to allow the supervisor to plan for the operation of the department.  Vacation time may only be taken in increments of one-half (1/2) day.

9.6: VACATION ACCRUAL:  Each regular and probationary full time employee shall accrue leave based on length of service, in accordance with the following rate table:

        0 thru 4th year……………………………….. 80 hours
        Year 5 thru 10th year………………………...120 hours
        Year 11 and beyond…………………………160 hours

9.11: SICK LEAVE ACCRUAL:  The maximum sick leave accrual shall be two hundred forty (240) hours that can be carried over on the employee’s anniversary date.  Any amount of sick leave that exceeds the maximum hours will be written off and forfeited by the employee.
