ADOPTING 2006 CHANGES TO THE 2004 COMPILATION OF THE UNIFORM TRAFFIC
ORDINANCE
WHEREAS, the Village of Capitan has adopted the 2004 Compilation of the
Uniform Traffic Ordinance, and
WHEREAS, the legislature adopted changes amending the following
sections:
Section 12-6-12.2 (OPERATING A MOTOR VEHICLE UNDER THE INFLUENCE OF
INTOXICATING LIQUOR OR DRUGS; PENALTIES; SENTENCING; FEES) Subsection
G-2 to replace the word “that” with “than”, and Subsection J correcting
the sentence “If the municipal judge decides to defer the execution of
a sentence, such deferral shall be granted only as allowed in
Subsection “K” of this section”.
Section 12-9-9 (PARKING IN DESIGNATED DISABLED PARKING SPACES)
Subsection A to correct the sentence “Any person who violates this
section shall be subject to a fine of not less than two hundred fifty
dollars ($250) or more than five hundred dollars ($500). In
Subsection D, delete “have the authority to” and replace with
“may”. Add Subsection E which states Parking enforcement
personnel of each of the state educational institutions designated in
Article 12, Section 11 of the Constitution of New Mexico may issue
citations for violations of Subsection A of this section within the
exterior boundaries of lands under the control of their respective
institutions, except portions of those lands that are public highways
or streets. (66-7-352.6 NMSA 1987).
THEREFORE, be it ordained by the Governing Body of the Village of
Capitan that Section 12-6-12.2 and Section 12-9-9 be amended to read as
set forth herein.
