ORDINANCE 2006-______
AN ORDINANCE ESTABLISHING A RATE AND FORMULA FOR FIGURING ANY EXCESSIVE
USE WHICH OCCURS AS THE RESULT OF LINE LEAKAGE
WHEREAS, The Village of Capitan is a New Mexico municipality; and
WHEREAS, The Governing Body of the Village of Capitan is charged with
making laws to insure the efficient operation of the Village; and
WHEREAS, The Governing Body of the Village of Capitan acted in regular
session on Tuesday, September 12, 2006 to approve a rate and formula
for figuring any excessive use which occurs as the result of water line
leakage that applies to Title 9 Utilities, Chapter 2, Section 9-2-11: C
of the 2002 Village of Capitan Municipal Code. (Ordinance 99-1,
6-14-1999 and amended 2002 Code)
NOW THERFORE, be it ordained by the Governing Body of the Village of
Capitan that:
1. Title 9, Chapter 2, Section 9-2-11: C of
the 2002 Village of Capitan Municipal Code is hereby deleted and
replaced with this Ordinance.
2. The rate that will be charged for any
excess leak of gallons over the average billing will be charged at
$3.00 per 1,000 gallons.
3. An employee of the Village of Capitan water
department will certify that there is a leak.
4. The formula to figure the amount of a water
bill for a line leakage for residential, commercial, or industrial is
as follows:
