AN ORDIANCE THAT WILL INCREASE WATER RATES
FOR THE VILLAGE OF CAPITAN
WHEREAS, The Village of Capitan is a New Mexico municipality; and
WHEREAS, The Governing Body of the Village of Capitan is charged with
making laws to insure the efficient operation of the Village; and
WHEREAS, The Governing Body of the Village of Capitan acted in regular
session on June 10, 2008 to approve the following proposed changes to
Title 9 – Utilities – Chapter 2 – Water Service Regulations:
Section 9-2-8: Water Rates: Change: Water rates, for
zero to four thousand (0-4000) gallons usage to zero to six thousand
(0-6000) gallons usage (base rate), excluding New Mexico Gross Receipts
Taxes, shall be as follows:

Insert the following section:
B. On July 1 of each successive year beginning
with July 1, 2009, the minimum bill for Residential,
Institutional-Commercial, and Industrial shall increase $.25 per month
to reflect the consumer price index.

E. Water Rates for the Bulk Water Station; Charges: All
water sold from the bulk water station will be charged at the rate of
thirty dollars ($30.00) per thousand gallons (1,000) or three cents
($.03) per gallon (1).
Section 9-2-9: Commodity Charges:
A. Residential Usage: Increase “Gallons
Per Month Usage in Excess of” from 4,000 gallons to 6,000 gallons.
B. Commercial-Institutional; Industrial Commodity
Charge: Increase “Gallons Per Month Usage In Excess of” from
4,000 gallons to 6,000 gallons.

Section 9-2-10: Unmetered Service:
B.(1) Rates Established: All water withdrawn from a fire
hydrant, pursuant to the provisions of subsection A of this section,
shall be charged at a commodity rate of twenty dollars ($20.00) per one
thousand (1,000) gallons changed to thirty dollars ($30.00) per one
thousand (1,000) gallons.
B.(3) Rates Established: Forest Service Fire Hydrant;
Charges: All water drawn from the hydrant at the U.S. Forest
Service will be charged at the commodity rate of two dollars ($2.00)
per one hundred (100) gallons or twenty dollars ($20.00) per one
thousand (1,000) gallons changed to a commodity rate of three dollars
($3.00) per one hundred (100) gallons or thirty dollars ($30.00) per
one thousand (1,000) gallons.
NOW THEREFORE, be it ordained by the Governing Body of the Village of
Capitan to include the changes made to Chapter 2 – Water Service
Regulations, Section 9-2-8 (A), Section 9-2-9, (A)(B), and Section
9-2-10 (B)(1)(3) of Title 9 – Utilities.
PASSED, APPROVED, AND ADOPTED THIS 10TH DAY OF JUNE, 2008.
