WHEREAS, the Village of Capitan staff has discovered that Lodgers’ Tax should be in a Special Revenue Fund; and

WHEREAS, the Governing Body in and for the Municipality of Capitan, State of New Mexico, meeting in a regular session on the 10 day of May 2005 did approve Resolution 2005-16, which created a Lodgers’ Tax Fund; and

WHEREAS, the Local Government Division did approve Resolution 2005-16 on the 12 day of May 2005; and

NOW THEREFORE, BE IT RESOLVED that the Governing Body of the Village of Capitan, meeting in regular session on the 14 day of June, 2005 does respectfully requests approval from the DFA to adjust the 2004 — 2005 budget by transferring $3,000 budgeted as an expenditure in the General Fund for lodgers’ tax disbursement to an expenditure in the newly created Lodgers’ Tax Fund. The balance in the Lodgers’ Tax Fund at the time of this resolution is $6,432.03.

DONE, PASSED AND APPROVED by the Governing Body of the Village of Capitan, Lincoln County, New Mexico on this 14 day of June 2005.
