WHEREAS, the Village of Capitan discovered an error of $3,089.00 between the Court Fund and the Law Enforcement Protection Fund and;

WHEREAS, there was an item in the amount of $3,089.00 paid from the LEPF in error, which should have been paid from the Court Fund and;

WHEREAS, the Governing Body in and for the Municipality of Capitan, State of New Mexico, meeting in regular session on the 14 day of June, 2005 does wish to inform the DFA of the correction of this error on May 9, 2005 and;

NOW THEREFORE, BE IT RESOLVED that the Governing Body of the Village of Capitan, meeting in regular session on the 14 day of June, 2005 does respectfully request approval from the DFA to adjust the 2004 — 2005 in the LEPF by increasing the budgeted expenditures in the amount of $3,089.00.

DONE, PASSED AND APPROVED by the Governing Body of the Village of Capitan, Lincoln County, New Mexico on this 14 day of June 2005.
