RESOLUTION 2006-31
A RESOLUTION REPEALING RESOLUTION 94-10 THAT ESTABLISHED A MORATORIUM
ON EXTRATERRITORIAL WATER CONNECTIONS AND NEW ANNEXATION INTO THE
VILLAGE OF CAPTIAN AND WOULD ALLOW EXTRATERRITORIAL WATER CONNECTIONS
AND NEW ANNEXATION INTO THE VILLAGE OF CAPITAN
WHERAS, in order to properly plan for the growth of the Village of
Capitan, a Water Advisory Board and Planning Board was created for the
purpose of assessing the quality and quantity of the existing water
supply and to plan a long range strategy for the acquisition of
additional water and storage capacity to meet the growing needs of the
Village; and
WHEREAS, the Village had previously adopted Resolution 94-10
establishing a moratorium on Extraterritorial Water Connections and New
Annexation; and
WHEREAS, the Water and Planning Boards and the Village Trustees have
determined an availability of an adequate municipal water supply to
repeal Resolution 94-10 and allow Exterritorial Water Connections and
new Annexation into the Village of Capitan; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE
OF CAPITAN TO:
1. Allow Extraterritorial Water Taps on
Property that might not be contiguous to the Village Limits, but is
adjacent to an existing water line with a restriction of
no more than 2 miles from
the Village limits.
2. The Water Supervisor with the Village of
Capitan would have final determination on the water line being of
sufficient size and capacity to add new water taps.
3. Allow annexation of new property into the
Village limits if the property is contiguous to the existing Village
limits and a water line sufficient in size and
capacity is
determined available by the Water Supervisor.
PASSED, APPROVED, AND ADOPTED by the Board of Trustees of the Village
of Capitan this 28th day of November, 2006.
