WHEREAS, the Village of Capitan is authorized to declare a building or structure ruined and being unsafe; and

WHEREAS, the mobile home located at 216 Valley View is partially burned and is a menace to the public comfort, health, peace or safety; and

WHEREAS, the Village of Capitan requires the owner to remove the structure from said address.  If the owner does not begin the removal within ten (10) days of the receipt of this notice, or file a written objection with the Village Clerk, the Village of Capitan may remove the building at the expense of the owner and place a lien on the property for the cost of the removal.

NOW THEREFORE BE IT RESOLVED that the Governing Body of the Village of Capitan meeting in regular session on the 9th day of January 2007 does approve of declaring the mobile home unsafe and demand the removal of the mobile home.

DONE, PASSED, AND APPROVED this 9th day of January, 2007 by the Governing Body of the Village of Capitan, New Mexico.
