WHEREAS, the Village of Capitan has a recorded water easement for a water line on Tract 6, Mesa Verde Acres, Unit III owned by Willie G. Romero; and

WHEREAS, the Village of Capitan does not need this water easement any more due to new water lines installed in the immediate area and the existing water line is capped off and is no longer needed; and

WHEREAS, the owner has requested the water line easement be vacated.

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Village of Capitan to vacate the existing water line easement on Tract 6, Mesa Verde Acres, Unit III.

DONE, PASSED, AND APPROVED by the Governing Body of the Village of Capitan at the regular meeting held on Tuesday, January 9, 2007.
