VILLAGE OF CAPITAN
RESOLUTION 2008-22
REMOVAL OF DANGEROUS BUILDING

WHEREAS, the Village of Capitan is authorized to declare a building or structure ruined and being unsafe; and

WHEREAS, the mobile home located in the 600 Block of Mt. Capitan Road, owned by David Clowe, is damaged and dilapidated and is a menace to the public comfort, health, peace or safety of the Village; and

WHEREAS, the Village of Capitan calls for the owner to remove the structure from said address.  If the owner does not begin the removal within ten (10) days of the receipt of this notice, or file a written objection with the Village Clerk, the Village of Capitan may remove the building at the expense of the owner and place a lien on the property for the cost of the removal.

NOW THEREFORE BE IT RESOLVED that the Governing Body of the Village of Capitan meeting in regular session on the 10th day of June 2008 does approve of declaring the mobile home unsafe and demand the removal of the mobile home.

DONE, PASSED, AND APPROVED this 10th day of June, 2008 by the Governing Body of the Village of Capitan, New Mexico.
